A proibição do Chega seria uma benção para os extremistas

O advogado António Garcia Pereira apresentou uma queixa à Procuradoria-Geral da República, pedindo que se avalie a legalidade da existência do Chega. Alega que o partido promove uma ideologia racista, apontando como exemplos os cartazes onde André Ventura afirma que “Portugal não é o Bangladesh” e os elogios ao regime de Salazar. Para Garcia Pereira, estas manifestações violam a Constituição e a lei dos partidos políticos. “A democracia não é nem pode ser um regime vale tudo”, afirmou à Rádio Renascença, justificando a iniciativa como forma de obrigar o Ministério Público a tomar posição.

 

Em resposta, André Ventura declarou à agência Lusa que uma eventual extinção do Chega “seria não só uma afronta à democracia, como seria extinguir a própria democracia”. Acrescentou que estas ações surgem sempre em períodos eleitorais e representam, segundo ele, uma tentativa de silenciar o partido pela força, e não pelo debate.

 

Este é um tema delicado, que exige uma análise jurídica rigorosa e uma reflexão política profunda. A Constituição portuguesa proíbe partidos que promovam ideologias fascistas ou racistas. Cabe às autoridades competentes determinar se os discursos e materiais do Chega se enquadram nessa definição. No entanto, é importante sublinhar que a Constituição não proíbe o populismo, a demagogia ou o elogio a regimes autoritários. Também não impede visões conservadoras ou nacionalistas, mesmo que contrárias ao cosmopolitismo que caracteriza grande parte da sociedade portuguesa.

 

Ser contrário a valores progressistas não é, por si só, sinónimo de racismo ou fascismo. Embora seja público que alguns apoiantes do Chega defendem ideias extremistas, os juristas não são unânimes quanto à natureza ideológica do partido. A interpretação da lei, neste caso, está longe de ser consensual - o mesmo se aplica à análise dos cartazes polémicos.

 

No plano político, a questão é ainda mais sensível. Proibir o Chega seria o equivalente a lançar uma bomba atómica no sistema político português, excluindo um quarto do eleitorado. Seria uma medida de força com consequências imprevisíveis, que poderia alimentar a vitimização e abrir espaço para alguns movimentos radicais que gravitam à direita do Chega. Esse eleitorado, privado de representação parlamentar, continuaria a existir e migraria para onde lhe dessem voz, dentro ou fora do sistema democrático. O risco de radicalização desse eleitorado, deixado órfão e descrente, seria real.

 

Por tudo isto, a democracia não se protege com silenciamentos, mas com debate, escrutínio e firmeza institucional. Manter o Chega dentro do sistema constitucional é, em si, uma forma de conter o extremismo de alguns dos seus dirigentes e apoiantes, tal como acontece, aliás, no polo ideológico oposto, onde existem pessoas que defendem regimes políticos onde o conceito de liberdade e democracia é muito diferente do nosso.

 

Em democracia, as ideias combatem-se com argumentos, não com proibições. Os valores democráticos são reforçados quando todos têm o mesmo direito de participar na vida política. E, ao contrário do que pensam muitos políticos e comentadores, o povo não é parvo.

Lawyer António Garcia Pereira filed a complaint with the Attorney General's Office, asking that the legality of the existence of Chega be evaluated. He alleges that the party promotes a racist ideology, pointing out as examples the posters where André Ventura states that "Portugal is not Bangladesh" and the praise for the Salazar regime. For Garcia Pereira, these demonstrations violate the Constitution and the law on political parties. "Democracy is not and cannot be an anything-goes regime," he told Rádio Renascença, justifying the initiative as a way to force the Public Prosecutor's Office to take a position.

 

In response, André Ventura declared to the Lusa agency that a possible extinction of Chega "would not only be an affront to democracy, but would be extinguishing democracy itself". He added that these actions always arise in election periods and represent, according to him, an attempt to silence the party by force, and not by debate.

 

This is a delicate issue, which requires rigorous legal analysis and deep political reflection. The Portuguese Constitution prohibits parties that promote fascist or racist ideologies. It is up to the competent authorities to determine whether Chega's speeches and materials fit this definition. However, it is important to underline that the Constitution does not prohibit populism, demagoguery or praise of authoritarian regimes. Nor does it prevent conservative or nationalist views, even if contrary to the cosmopolitanism that characterizes a large part of Portuguese society.

 

Being contrary to progressive values is not, in itself, synonymous with racism or fascism. Although it is public that some supporters of Chega defend extremist ideas, jurists are not unanimous about the ideological nature of the party. The interpretation of the law, in this case, is far from consensual - the same applies to the analysis of controversial posters.

 

On the political level, the issue is even more sensitive. Banning Chega would be the equivalent of dropping an atomic bomb on the Portuguese political system, excluding a quarter of the electorate. It would be a measure of force with unpredictable consequences, which could feed victimization and make room for some radical movements that gravitate to the right of Chega. This electorate, deprived of parliamentary representation, would continue to exist and would migrate wherever it was given a voice, inside or outside the democratic system. The risk of radicalization of this electorate, left orphaned and disbelieving, would be real.

 

For all this, democracy is not protected with silencing, but with debate, scrutiny and institutional firmness. Keeping Chega within the constitutional system is, in itself, a way of containing the extremism of some of its leaders and supporters, as it happens, in fact, in the opposite ideological pole, where there are people who defend political regimes where the concept of freedom and democracy is very different from ours.

 

In a democracy, ideas are fought with arguments, not with prohibitions. Democratic values are strengthened when everyone has the same right to participate in political life. And, contrary to what many politicians and commentators think, the people are not fools.
