A
Associação do Comércio Tradicional Bolha de Água (ACTBA), representativa de
mais de 50 por cento dos comerciantes do Mercado do Bolhão e da qual fazem
parte os chamados “históricos”, avançou com uma denúncia dirigida ao
procurador-geral da República contra a Go Porto, empresa municipal responsável
pela gestão do mercado. Em causa, lê-se na exposição enviada a Amadeu Guerra e
a que o DN teve acesso, está “a prática de atos alegadamente passíveis de ter
enquadramento no Código Penal, ou seja, a possível existência de atos corruptos
na gestão do Mercado do Bolhão”, pedindo a ACTBA a abertura de inquérito para
averiguação.
“Tais
atos, alegadamente”, acrescenta-se, “terão sido praticados pela empresa Go
Porto, EM, identificando-se na sua execução e responsabilização a
vice-presidente do Conselho de Administração, Cátia Meirinhos, e a diretora de
Gestão e Exploração, Sónia da Rocha”. A prática que se apresenta como passível
de ser “alegadamente irregular e com viés” incide sobre os concursos públicos
para atribuição das bancas no interior do Mercado do Bolhão e na gestão da
aplicação e fiscalização do regulamento daquele espaço emblemático da cidade.
Mas não
só. Esta semana, a ACTBA apresentou uma participação cívica na Inspeção-Geral
de Finanças, solicitando a realização de uma auditoria à gestão da Go Porto,
visando “a aplicação e fiscalização do Regulamento do Mercado do Bolhão,
incluindo a aplicação de coimas, o cumprimento dos contratos de arrendamento
das lojas exteriores, a equidade e justiça no acesso aos concursos públicos
para atribuição das bancas, lojas e restaurantes, os contratos de serviços
externos com ênfase no contrato de “Facility Management” no valor de 3,6
milhões de euros e o contrato de Decoração de Natal 2024”.
Uma
terceira queixa foi enviada à ASAE, que em outubro passado procedeu ao
levantamento de autos a duas comerciantes históricas, associadas da ACTBA, por
falta de condições para a confeção de tripas “quando a responsabilidade dessas
condições deficitárias de laboração são apenas e só da Go Porto, a quem há mais
de um ano a Associação pediu intervenção”. Sem resposta, lê-se no documento.
“Estas
queixas tiveram seguimento depois de esgotadas todas as tentativas de diálogo e
de pedidos de esclarecimento e resolução das problemáticas identificadas no
Mercado do Bolhão junto tanto do Conselho de Administração da entidade gestora,
Go Porto, como da Câmara Municipal do Porto”, diz ao DN Helena Ferreira,
presidente da ACTBA.
Ermelinda
da Silva Lopes, histórica comerciante do Bolhão, acompanha as decisões da
ACTBA. “Esta é uma guerra que não vamos abandonar. Somos tesos e constituímos
advogados. Tenho 68 anos e vim para este mercado na barriga da minha mãe, não
me vão expulsar daqui. Meteram-me numa banca num canto, mas não vou deixar que
transformem isto num monte de restaurantes de comida estrangeira”, diz ao DN,
do alto da sua banca de peixes e congelados.
Uns podem
e outros não?

Lopes quer que a Go Porto explique por que razão uma atividade histórica,
“integrante da cultura gastronómica portuense e autorizada, como a preparação
das tripas enfarinhadas”, está na mira da ASAE e, simultaneamente, outras
bancas “continuam a cozinhar sem exaustão”. Dá exemplos: “A diretora de Gestão
e Exploração, Sónia da Rocha, proibiu-me de ter na banca umas pencas que eram
de um cliente, veja o ridículo, mas acompanhou o senhor da ASAE na visita e não
lhe mostrou as bancas onde se cozinham massas”.

Ferreira diz “estarmos a falar de atividades que a associação considera
ilegais, em colisão com a aplicação dos regulamentos e normas de funcionamento
do Mercado do Bolhão e em incumprimento com os termos dos concursos públicos.”
A dinamizadora associativa, ela própria em litígio pessoal com o Executivo de
Rui Moreira, estranha “as exceções concedidas pela Go Porto para as referidas
bancas, uma vez que no objeto concursal consta comercialização de produtos, e
não atividades de restauração como as que se confirmam no local”, diz,
lembrando que “o regulamento proíbe expressamente cozinhar nas bancas, exceção
para as tripas”. “Em nenhum momento e em nenhum documento foram estabelecidas
ou comunicadas condições de exceção que justifiquem no Mercado do Bolhão
existirem bancas a funcionar como autênticos restaurantes, essencialmente de
comida italiana e asiática”.
Ermelinda
Lopes garante: “Não queremos virar-nos contra os outros comerciantes, mas sim
contra quem manda e permite a uns o que proíbe a outros, os mais antigos, não
lhes dando condições de trabalho. Mas vamos fazer-lhes a vida negra.”

Luísa
Ferreira da Silva tem 65 anos e uma banca de charcutarias. Trabalha no Bolhão
desde os 10. “Já a minha avó cozinhava aqui as tripas.” Não contesta a decisão
da ASAE. Apenas que essa decisão a obrigue a atravessar o Bolhão com quilos de
carnes. “Quem eu critico são as pessoas que não me dão condições para poder
cozinhar.” Conta o dia a dia: “Carrego as carnes num carro de mão até às
cozinhas, que são no lado oposto ao da minha banca. Tenho de subir escadas até
ao andar de cima e até as cozinhas não têm condições. E depois dizem aquelas
pessoas que não querem acabar com as tripas. Querem e querem correr connosco”,
concluiu, secundada por Fernanda, 76 anos, outra das resistentes. “É cruel o
que nos estão a fazer.”
Luísa
descreve: “Aqui só cheira a massas a cozer e a queijos derretidos. A estrugido,
a fritos nas Air Fryer. Tudo é permitido, menos as nossas tripas.”
Helena
Ferreira, eleita presidente da associação há um ano, reforça: “Temos alertado e
solicitado intervenção para correção das falhas, mas a situação persistiu e,
agora, confirmaram-se os receios desta associação no decorrer de uma ação de
fiscalização da ASAE.”
Isto
tornou-se uma taberna
“No verão
é ver as pessoas a passear pelo mercado de copos na mão. Sentados no chão, a
comer e a beber, partem os copos, fazem trinta por uma linha”, repete Ermelinda
Lopes, que faz questão de dizer que nada tem contra os turistas. “É uma gente
que vem cá comprar, apesar de terem posto aqui perto um Continente a fazer-nos
concorrência, de tal maneira que queriam chamar-lhe Continente Bolhão, mas
tiveram de arrepiar caminho. Bolhão somos nós”, diz a lojista, avisando: ”Somos
um mercado de frescos e continuaremos ser, por muito que a Go Porto queira
fazer disto uma praça de restauração”. Helena Ferreira teme que “de uma forma
encapotada e ilícita, haja em vista uma hipotética e futura privatização do
espaço”, exigindo a Associação que a discussão de novos regulamentos seja feita
pelo Executivo camarário que vier a resultar das próximas autárquicas,
pretensão que segundo o DN apurou já foi reconhecida por Rui Moreira.
Go Porto
reage
“A Go
Porto encontra-se disponível para colaborar com qualquer investigação que se
venha a verificar necessária, na certeza de que manterá a sua tranquilidade e
que de tudo fará para servir o interesse público e a cidade do Porto no que
respeita ao Mercado do Bolhão”, afirma ao DN a Go Porto, em respostas enviadas
por escrito, recordando estar em causa “um edifício extremamente complexo, de
um imóvel classificado como de interesse público que foi sujeito a obras
profundas de reabilitação e de modernização”, havendo “situações impossíveis de
antecipar em fase de projeto e que só com o seu funcionamento e ao longo do
tempo vão sendo detetadas”.
No
entanto, garante, “todas as circunstâncias que eram suscetíveis de imediata
resolução, assim o foram”. Sobre a inspeção da ASAE, a Go Porto afirma que esta
não “deu lugar à interrupção da atividade de preparação das tripas”, ainda que
não justifique “o calvário” que é fazer chegar as carnes às cozinhas, com
instalações de gás impróprias, garantindo que a questão técnica ficará “sanada
na próxima semana”.
Quanto à
acusação de dualidade de critérios, a Go Porto justifica-se com “as novas
realidades”. “Os próprios comerciantes foram-se adaptando, procurando e criando
novas oportunidades de negócio que, em muitos casos, extravasaram algumas das
regras que foram inicialmente pensadas”. E garante que “a direção do Mercado,
ao longo do tempo, sempre procurou sensibilizar os comerciantes para as
limitações existentes, o que nem sempre é fácil quando o regulamento ainda em
vigor é omisso em relação a muitos aspetos”. Por último, a Go Porto rejeita a
acusação de que pretenda transformar o mercado numa praça de alimentação. “A
génese do Bolhão será sempre salvaguardada e essa é a missão central da
entidade gestora do Mercado.”

The
Association of Traditional Water Bubble Commerce (ACTBA), representing more
than 50 percent of the traders in the Bolhão Market and of which the so-called
"historical" are part, has filed a complaint addressed to the
Attorney General of the Republic against Go Porto, the municipal company
responsible for managing the market. At stake, reads the statement sent to
Amadeu Guerra and to which DN had access, is "the practice of acts
allegedly liable to fall under the Penal Code, that is, the possible existence
of corrupt acts in the management of the Bolhão Market", asking ACTBA to
open an investigation to investigate.
"Such
acts, allegedly", it adds, "will have been practiced by the company
Go Porto, EM, identifying in their execution and accountability the
vice-president of the Board of Directors, Cátia Meirinhos, and the director of
Management and Exploration, Sónia da Rocha". The practice that is
presented as likely to be "allegedly irregular and biased" focuses on
the public tenders for the allocation of stalls inside the Bolhão Market and on
the management of the application and supervision of the regulation of that
emblematic space of the city.
But not
only. This week, ACTBA presented a civic participation in the General
Inspectorate of Finance, requesting an audit of the management of Go Porto,
aiming at "the application and supervision of the Bolhão Market
Regulation, including the application of fines, compliance with the lease
contracts of the external stores, equity and justice in access to public
tenders for the allocation of stalls,
shops and restaurants, the external service contracts with an emphasis
on the "Facility Management" contract worth 3.6 million euros and the
Christmas Decoration 2024 contract".
A third
complaint was sent to ASAE, which last October proceeded to collect records
from two historic traders, members of ACTBA, for lack of conditions for the
manufacture of casings "when the responsibility for these deficient
working conditions is only and only Go Porto, to which the Association has
asked for intervention for more than a year". No response, reads the
document.
"These
complaints were followed up after all attempts at dialogue and requests for
clarification and resolution of the problems identified in the Bolhão Market
with both the Board of Directors of the managing entity, Go Porto, and the
Porto City Council," Helena Ferreira, president of ACTBA, tells DN.
Ermelinda
da Silva Lopes, a historic merchant from Bolhão, follows the decisions of the
ACTBA. "This is a war that we will not abandon. We are tough and we are
lawyers. I'm 68 years old and I came to this market in my mother's belly,
they're not going to kick me out of here. They put me in a stall in a corner,
but I'm not going to let them turn this into a bunch of foreign food
restaurants", he tells DN, from the top of his fish and frozen food stall.
Some can
and others cannot?

Lopes wants Go Porto to explain why a historical activity, "part of
Porto's gastronomic culture and authorized, such as the preparation of floured
tripe", is in ASAE's sights and, at the same time, other stalls
"continue to cook without exhaustion". He gives examples: "The
director of Management and Exploration, Sónia da Rocha, forbade me to have a
bunch of boxes that belonged to a customer at the stall, see the
ridiculousness, but she accompanied the gentleman from ASAE on the visit and
did not show him the stalls where pasta is cooked".
Helena
Ferreira says "we are talking about activities that the association
considers illegal, in collision with the application of the regulations and
operating standards of the Bolhão Market and in non-compliance with the terms
of public tenders." The associative promoter, herself in personal dispute
with Rui Moreira's Executive, is surprised "by the exceptions granted by
Go Porto for the aforementioned stalls, since the tender object includes the
sale of products, and not catering activities such as those confirmed on
site", she says, recalling that "the regulation expressly prohibits
cooking at the stalls, except for the
guts". "At no time and in no document were conditions of exception
established or communicated that justify in the Bolhão Market there are stalls
operating as authentic restaurants, essentially of Italian and Asian
food".
Ermelinda
Lopes guarantees: "We don't want to turn against other traders, but
against those who command and allow some what they prohibit others, the oldest,
not giving them working conditions. But let's make their lives black."

Ferreira da Silva is 65 years old and has a delicatessen stall. He has worked
at Bolhão since he was 10. "My grandmother used to cook the tripe
here." He does not contest ASAE's decision. Only that this decision forces
her to cross Bolhão with kilos of meat. "The ones I criticize are the
people who don't give me the conditions to be able to cook." He tells the
day to day: "I carry the meat in a wheelbarrow to the kitchens, which are
on the opposite side of my stall. I have to climb stairs upstairs and even the
kitchens are not in good condition. And then those people say that they don't
want to end their guts. They want and want to race with us", she
concluded, seconded by Fernanda, 76, another of the resistants. "It's
cruel what they're doing to us."
Luísa
describes: "Here it only smells of pasta baking and melted cheeses. To
steam, to fried in the Air Fryer. Everything is allowed, except our guts."
Helena
Ferreira, elected president of the association a year ago, reinforces: "We
have alerted and requested intervention to correct the failures, but the
situation persisted and now the fears of this association have been confirmed
during an inspection action by ASAE."
This
became a tavern
"In
the summer it's seeing people walking through the market with glasses in hand.
Sitting on the floor, eating and drinking, they break the glasses, they make
thirty for a row", repeats Ermelinda Lopes, who makes a point of saying
that she has nothing against tourists. "It's a people who come here to
buy, despite having put a Continente nearby to compete with us, in such a way
that they wanted to call it Continente Bolhão, but they had to make a mistake.
Bolhão is us", says the shopkeeper, warning: "We are a fresh market
and we will continue to be, no matter how much Go Porto wants to make this a
food court". Helena Ferreira fears that "in a disguised and illicit
way, there is a hypothetical and future privatization of the space",
demanding the Association that the discussion of new regulations be made by the
City Council Executive that will result from the next municipal elections, an
intention that according to DN has already been recognized by Rui Moreira.
Go Porto
reacts
"Go
Porto is available to collaborate with any investigation that may be necessary,
in the certainty that it will maintain its tranquility and that it will do
everything to serve the public interest and the city of Porto with regard to
the Bolhão Market", Go Porto tells DN, in written responses, recalling that this is "an extremely
complex building, of a property classified as of public interest that has been
subject to extensive rehabilitation and modernization works", and there
are "situations that are impossible to anticipate in the design phase and
that only with its operation and over time will be detected".
However,
he guarantees, "all the circumstances that were susceptible to immediate
resolution, were so". Regarding ASAE's inspection, Go Porto states that it
did not "give rise to the interruption of the tripe preparation
activity", although it does not justify "the ordeal" that is to
get the meat to the kitchens, with improper gas installations, guaranteeing
that the technical issue will be "resolved next week".
As for
the accusation of double standards, Go Porto justifies itself with "the
new realities". "The merchants themselves have been adapting, looking
for and creating new business opportunities that, in many cases, have gone
beyond some of the rules that were initially thought of". And he
guarantees that "the direction of the Market, over time, has always sought
to make traders aware of the existing limitations, which is not always easy
when the regulation still in force is silent in relation to many aspects".
Finally, Go Porto rejects the accusation that it intends to transform the
market into a food court. "The genesis of Bolhão will always be
safeguarded and that is the central mission of the Market's management
entity."
