Zero Licensing to Protect Traditional Commerce

In 2011,
Portugal was under financial rescue from the Troika and urgently needed to
boost the economy and reduce administrative costs. Bureaucracy was seen as one
of the biggest obstacles to investment and the entry of new businesses. The
answer was to change the State's strategy: instead of prior licensing, the
entrepreneur's declaration was trusted, reinforcing subsequent inspection. Zero
Licensing was born, in a context in which Portugal needed to simplify processes
and create conditions for those who wanted to invest, create jobs and open a
business.
But a
rule designed to simplify cannot become a rule that prevents the municipality
from responding to the transformation of the territory. Meanwhile, the reality
has changed. The recession is over, unemployment has fallen and Portugal has
seen a strong growth in tourism and real estate investment. A solution designed
for a certain reality may, over time, reveal limitations in the face of a
different reality.
Where
there used to be a neighborhood grocery store, today there may be successive
souvenir shops or similar convenience businesses, with five, six, seven or
eight workers, selling the same products, such as cloths or roosters from
Barcelos, and without customers for much of the day. The question is simple:
how can these businesses support such high rents? It is a reality that can be
seen, evidently, in Rua Direita de Cascais, which no longer has the same
commercial identity it has always had. Traditional commerce faces difficulties
to compete and the historic centers are beginning to lose part of their
identity.
Cascais
has a duty to protect its territory, its identity and its community. It is
necessary to give municipalities the ability to have prior control over certain
economic activities, to stop the uncontrolled proliferation of façade shops
that de-characterize historic centers.
It is not
a question of being against commerce, investment or new businesses. It is a
question of asking whether all streets, all areas and all territories should be
subject to exactly the same rules. A historic centre subject to strong tourist
pressure does not necessarily face the same problems as a business or
residential area. The local reality matters and the answers must also be able
to be local.
Cascais
was one of the drivers of this debate, through the public petition launched by
the Parish Council of Cascais and Estoril, of which I was the first signatory,
which gathered more than 11,000 signatures and took this issue to the Assembly
of the Republic. In September 2026, we again signaled this need to the
Government. It is therefore important that the Government now moves forward
with a legislative amendment that creates exceptions to Zero Licensing,
allowing for better protection of traditional commerce and giving
municipalities tools to respond to the reality of their territories.
Licensing
less can be important. But deciding better is essential.

Em 2011,
Portugal estava sob resgate financeiro da Troika e precisava urgentemente de
dinamizar a economia e reduzir custos administrativos. A burocracia era vista
como um dos maiores travões ao investimento e à entrada de novos negócios. A
resposta passou por mudar a estratégia do Estado: em vez do licenciamento
prévio, passou-se a confiar na declaração do empresário, reforçando a
fiscalização posterior. Nascia o Licenciamento Zero, num contexto em que
Portugal precisava de simplificar processos e criar condições para quem queria
investir, criar emprego e abrir um negócio.
Mas uma
regra pensada para simplificar não pode tornar-se numa regra que impede o
município de responder à transformação do território. Entretanto, a realidade
mudou. A recessão acabou, o desemprego caiu e Portugal assistiu a um forte
crescimento do turismo e do investimento imobiliário. Uma solução desenhada
para uma determinada realidade pode, com o tempo, revelar limitações perante
uma realidade diferente.
Onde
antes existia uma mercearia de bairro, podem hoje surgir sucessivas lojas de
souvenirs ou negócios de conveniência semelhantes, com cinco, seis, sete ou
oito trabalhadores, a vender os mesmos produtos, como panos ou galos de
Barcelos, e sem clientes durante grande parte do dia. A questão é simples: como
conseguem estes negócios suportar rendas tão elevadas? É uma realidade que se
vê, de forma evidente, na Rua Direita de Cascais, que já não tem a mesma
identidade comercial que sempre teve. O comércio tradicional enfrenta
dificuldades para competir e os centros históricos começam a perder parte da
sua identidade.
Cascais
tem o dever de proteger o seu território, a sua identidade e a sua comunidade.
É necessário dar às autarquias capacidade de controlo prévio sobre determinadas
atividades económicas, para travar a proliferação descontrolada de lojas de
fachada que descaracterizam os centros históricos.
Não se
trata de ser contra o comércio, o investimento ou os novos negócios. Trata-se
de perguntar se todas as ruas, todas as zonas e todos os territórios devem
estar sujeitos exatamente às mesmas regras. Um centro histórico sujeito a forte
pressão turística não enfrenta necessariamente os mesmos problemas que uma zona
empresarial ou residencial. A realidade local importa e as respostas também
devem poder ser locais.
Cascais
foi um dos motores deste debate, através da petição pública lançada pela Junta
de Freguesia de Cascais e Estoril, da qual fui o primeiro subscritor, que
reuniu mais de 11.000 assinaturas e levou esta questão à Assembleia da
República. Em setembro de 2026, voltámos a sinalizar ao Governo esta
necessidade. É por isso importante que o Governo avance agora com uma alteração
legislativa que cria exceções ao Licenciamento Zero, permitindo proteger melhor
o comércio tradicional e dar às autarquias instrumentos para responder à
realidade dos seus territórios.
Licenciar
menos pode ser importante. Mas decidir melhor é essencial.
