Rossio's historic jewellery gets protection in court, but is still not free
from eviction
One
hundred years ago in Rossio, Ferreira Marques Jewellery has seen its status as
a Shop with History recognized. It will continue to have its doors open,
although without definitive certainties about the future.

Ferreira Marques has won a first court battle against the real estate company
that has owned the property where it has been installed for more than 100
years. The Rossio store, in Lisbon, saw the Judicial Court of the District of
Lisbon grant it legal protection under the Shop with History statute, after the
owner of the space tried to submit the contract to the NRAU (New Urban Lease
Regime) before the expected legal term. The court decision has not yet become
final. The jewelry store admits that the owner will appeal.
The
transition to the NRAU lease regime of a contract prior to 1990 would allow the
owner to gradually update the rent value. After five years (transition period),
the contract could assume the rules of the free market. A situation that, in
the limit, could lead to the eviction of the jewellery store in the near
future. As a Shop with History, it is protected and the rules for renewing the
lease are those stipulated in the original contract.
With an
Art Nouveau style façade, the store has been associated over the years with
cultural moments in the city and others that go beyond the doors of Lisbon. As
Paula Gião, director of the space, said, it is at Joalharia Ferreira Marques
that James Bond, in the 1962 film "On Her Majesty's Service" (the
second in the series), buys an engagement ring. It is also the setting for
"Singularities of a Blonde Girl", by Manoel de Oliveira.
"Recognizing
a Shop with History must also mean protecting it. It is not about calling into
question the right to property, but about ensuring that the recognition of an
establishment as a Shop with History is not reduced to a merely symbolic distinction
and has concrete consequences, under the terms provided for by law",
defends Sandra Condesso, vice-president of the Union of Commerce and Services
Associations (UACS).
For this
official, "the sentence now known is particularly important" because
it recognizes the protection provided for and "considers that the
landlord's initiative could not determine the submission of the contract to the
NRAU before the legally established deadline". In the opinion of UACS,
"lease protection is a fundamental dimension to ensure the continuity of
these stores and preserve part of the commercial identity of our cities".
"Shops
like ours are closing every month", laments Paula Gião, who argues that
the city "cannot live off tourism if it has nothing characteristic to
give". She recalls that "it is not intended that tourists come once
and not come back. Tourists are tired of this turmoil, of the same things
everywhere. It's just food and drinks in Baixa".
Paula
Gião urges the people of Lisbon to intervene, to travel to Baixa. "We won
the process and it was very good", but "civil society has to be
called to responsibility".
Joalharia
Ferreira Marques is a family business that is already in its fourth generation.
It celebrated 100 years in July. With six employees, it creates, sells and
repairs jewellery.

Joalharia Ferreira Marques ganhou uma primeira batalha em tribunal contra a
empresa imobiliária que detém o imóvel onde está instalada há mais de 100 anos.
A loja do Rossio, em Lisboa, viu o Tribunal Judicial da Comarca de Lisboa
conferir-lhe proteção legal ao abrigo do estatuto Loja com História, depois da
proprietária do espaço ter tentado submeter o contrato ao NRAU (Novo Regime do
Arrendamento Urbano) antes do termo legal previsto. A decisão judicial ainda
não transitou em julgado. A joalharia admite que a proprietária vá recorrer.
A
passagem para o regime de arrendamento NRAU de um contrato anterior a 1990
permitiria à proprietária atualizar gradualmente o valor da renda. Ao fim de
cinco anos (período de transição), o contrato poderia assumir as regras do
mercado livre. Uma situação que, no limite, poderia levar ao despejo da
joalharia num futuro breve. Como Loja com História, está protegida e as regras
de renovação do arrendamento são as estipuladas no contrato original.
Com uma
fachada ao estilo Arte Nova, a loja tem-se associado ao longo dos anos a
momentos culturais da cidade e outros que extravasam as portas de Lisboa. Como
contou Paula Gião, diretora do espaço, é na Joalharia Ferreira Marques que
James Bond, no filme "Ao serviço de Sua Majestade", de 1962 (o
segundo da série), compra um anel de noivado. É também cenário de
"Singularidades de uma Rapariga Loura", de Manoel de Oliveira.
“Reconhecer
uma Loja com História tem de significar também protegê-la. Não se trata de
colocar em causa o direito de propriedade, mas de garantir que o reconhecimento
de um estabelecimento como Loja com História não fica reduzido a uma distinção
meramente simbólica e tem consequências concretas, nos termos previstos na
lei", defende Sandra Condesso, vice-presidente da União das Associações de
Comércio e Serviços (UACS).
Para esta
responsável, "a sentença agora conhecida é particularmente
importante" porque reconhece a proteção prevista e "considera que a
iniciativa do senhorio não poderia determinar a submissão do contrato ao NRAU
antes do prazo legalmente previsto". Na opinião da UACS, "a proteção
do arrendamento é uma dimensão fundamental para garantir a continuidade destas
lojas e preservar uma parte da identidade comercial das nossas cidades”.
"Lojas
como a nossa estão a fechar todos os meses", lamenta Paula Gião, que
defende que a cidade "não pode viver do turismo se não tiver nada de
característico para dar". Lembra que "não se pretende que os turistas
venham uma vez e não voltem. Os turistas estão cansados deste tumulto, de
coisas iguais em todo o lado. É só comes e bebes na Baixa".
Paula
Gião insta os lisboetas a intervir, a deslocar-se à Baixa. "Ganhámos o
processo e foi muitíssimo bom", mas "a sociedade civil tem que ser
chamada à responsabilidade".
A
Joalharia Ferreira Marques é uma empresa familiar que já vai na quarta geração.
