Under this mandate, providers must ensure that synthetic text, audio, images, and video are identifiable via machine-readable markings.

Because maintaining different product ecosystems for different regions is costly and inefficient, tech giants are implementing these watermarks globally—a phenomenon known as the "Brussels Effect."

How the Tech Giants are Responding

  • Anthropic: Following its alignment with the EU AI Act's Code of Practice, Anthropic announced it is embedding invisible, machine-readable watermarks globally across all Claude models (including Claude API, Claude Code, and Claude Cowork). The watermark alters word choices mathematically to remain hidden to readers but highly detectable by software, surviving even light editing, copying, and pasting.
  • Google: Google has already fallen in line by actively deploying watermarking techniques for text generated through its Gemini models.
  • OpenAI & Others: While OpenAI has historically researched text watermarking, pressure is mounting for a formal production rollout to comply with the new rules. Meanwhile, creative platforms like the AI music generator Suno have also committed to marking tracks following recent legal scrutiny.

The Mechanism: Multi-Layered Marking

The European Commission's guidelines mandate a multi-layered verification framework:

1.      Digitally Signed Metadata: Providers embed tamper-evident, time-stamped information using standards like the C2PA provenance metadata framework.

2.      Imperceptible Watermarking: Subtle mathematical tweaks or noise are injected directly into the data matrix (words, pixels, or audio frequencies).

Real-World Impacts & Controversies

  • The "Processed vs. Authored" Blur: If a user writes an original piece of text but runs it through an AI for simple proofreading or grammar correction, the tool may still inject an invisible watermark, potentially falsely flagging the user's work as wholly machine-generated.
  • Performance Penalties: Tech experts argue that restricting word choice to accommodate mathematical watermarking constraints can inadvertently reduce the creativity and linguistic quality of LLM outputs.
  • Open-Source Divergence: Because bad actors can easily strip or bypass watermarks using unrestricted open-source models, legitimate users and commercial entities bear the operational and legal burdens of disclosure.
  • Global Legal Shift: The regulation does not just apply to tech companies; any business or creator publishing AI-assisted commercial client work or ads targeting European audiences must ensure clear disclosure to avoid steep penalties
