Influencer. Judgment of the Court of Appeal "was not known" to the
Attorney General
The
judgment of the Court of Appeal that was delaying Operation Influencer was not
known to either the magistrates or Amadeu Guerra, indicates the Attorney
General's Office.

The
Attorney General's Office now clarifies, in a response sent to RTP, that the
judgment of the Lisbon Court of Appeal that was conditioning the progress of
Operation Influencer only arrived on Tuesday at the Department of Investigation
and Criminal Action.The Court of Appeal had denied that it was considering any
appeal by the defendants of Operation Influencer, after the prosecutor said
that investigators were still waiting for a decision. At issue is the appeal
against an order of the criminal investigating judge who rejected a complaint.
"The
appeal in question focused on the order of the criminal investigation judge who
rejected the complaint filed under article 77 of the Statute of the Bar
Association", reads the response of the Attorney General's Office.
"The
judgment was handed down by the Lisbon Court of Appeal, went down to the TCIC
on October 27 and arrived yesterday at the DCIAP. Until that moment, it was not
known to either the magistrates of the DCIAP, nor the attorney general."
"The
judgment upheld the appeal. As it comes to lawyers' e-mails, the Lisbon Court
of Appeal will now assess the possible breach of professional secrecy. At the
moment, it is still not possible to access the email of lawyers. As it is a
question of lawyers' e-mails, the Lisbon Court of Appeal will now assess the
possible breach of professional secrecy", concludes Amadeu Guerra's
office.
"We
cannot move forward"
Last
Friday, the Attorney General of the Republic stated that, within the scope of
Operation Influencer, the work of the Public Prosecutor's Office was dependent
on an appeal filed by the defendants, under consideration at the Lisbon Court
of Appeal.
"Email
was seized during the process, the defendants filed an appeal. As long as we
don't have access to the information in the emails, we can't move
forward", declared Amadeu Guerra at the time, on the sidelines of a
meeting of the Victim Support Offices at the Attorney General's Office.On
November 7, 2023, as part of Operation Influencer, five people were arrested
and then released, including Vítor Escária, chief of staff of former Prime
Minister António Costa.
The
investigation focuses on suspected crime in the construction of a data center
in Sines, in the exploration of lithium in Montalegre and Boticas and in the
production of energy, from hydrogen, also in Sines.
This
process led to the fall of the socialist government. The current president of
the European Council was considered a suspect, but was not made a defendant.
