O
Presidente da República afirmou este domingo, 3 de agosto, que a maioria
parlamentar que quis alterar a lei de estrangeiros “será oportunamente julgada
por isso”, reservando mais comentários sobre o que fará para depois da decisão
do Tribunal Constitucional.
O
Presidente da República, Marcelo Rebelo de Sousa, defendeu que, neste momento,
sobre a lei de estrangeiros, o que interessa “é haver certeza quanto ao direito
que se pretende mudar” e que isso “fica esclarecido com a intervenção do
Tribunal Constitucional”, acrescentando que, politicamente, “fica para a
história” que houve uma maioria que “quis essas soluções e oportunamente será
julgada por isso”.
Marcelo
Rebelo de Sousa falava aos jornalistas à margem de uma visita ao Teleporto de
Santa Maria, nos Açores, após ser questionado sobre o que fará caso o Tribunal
Constitucional não concorde com as dúvidas sobre a nova lei de estrangeiros que
o fizeram enviar o diploma para o Palácio Ratton.
“Em
relação ao debate político, pensarei nisso logo a seguir, ponderarei se sim ou
não vale a pena, por uma questão de afirmação pessoal, colocar um entrave
político à lei por três semanas, ou por 15 dias, sabendo que vai ser aprovada
na volta do correio. Ou se não é possível fazer o mesmo de outra maneira, que é
dizer ‘eu promulgo, mas discordo politicamente’”, disse ainda Marcelo Rebelo de
Sousa.
Marcelo
afirmou também não ter “grandes dúvidas políticas que não tenham a ver com as
questões jurídicas suscitadas” e que precisa, para decidir o que fará
posteriormente, de perceber se o Constitucional considera que a lei “choca
muito com o essencial das ideias da Constituição ou não choca”.
O
Presidente da República explicou ainda que “ao privilegiar a ida ao Tribunal
Constitucional, não seguiu, à partida, o caminho do veto político” e que
considera “mais útil saber se há razão para haver dúvidas de
constitucionalidade” porque “mais vale prevenir do que remediar”.
O
Presidente da República submeteu, a 24 de julho, ao Tribunal Constitucional o
decreto do parlamento que altera o regime jurídico de entrada, permanência,
saída e afastamento de estrangeiros do território nacional, aprovado por PSD,
Chega e CDS-PP.
O chefe
de Estado pediu a fiscalização preventiva da constitucionalidade das normas
sobre direito ao reagrupamento familiar e condições para o seu exercício, sobre
o prazo para apreciação de pedidos pela Agência para a Integração Migrações e
Asilo (AIMA) e o direito de recurso.

The
President of the Republic said this Sunday, August 3, that the parliamentary
majority that wanted to change the law on foreigners "will be judged in
due course for this", reserving more comments on what he will do after the
decision of the Constitutional Court.
The
President of the Republic, Marcelo Rebelo de Sousa, argued that, at this
moment, regarding the law on foreigners, what matters "is to be sure about
the law that is intended to change" and that this "is clarified with
the intervention of the Constitutional Court", adding that, politically,
"it goes down in history" that there was a majority that "wanted
these solutions and will be judged for it in due course".
Marcelo
Rebelo de Sousa was speaking to journalists on the sidelines of a visit to the
Santa Maria Teleport, in the Azores, after being asked what he will do if the
Constitutional Court does not agree with the doubts about the new law on
foreigners that made him send the diploma to the Ratton Palace.
"Regarding
the political debate, I will think about it right away, I will consider whether
or not it is worthwhile, for the sake of personal statement, to put a political
obstacle to the law for three weeks, or for 15 days, knowing that it will be approved
when the mail returns. Or if it is not possible to do the same in another way,
which is to say 'I promulgate, but I disagree politically'", said Marcelo
Rebelo de Sousa.
Marcelo
also said he does not have "major political doubts that have nothing to do
with the legal issues raised" and that he needs, to decide what he will do
later, to understand whether the Constitutional considers that the law
"clashes a lot with the essence of the ideas of the Constitution or does
not".
The
President of the Republic also explained that "by privileging going to the
Constitutional Court, he did not follow, from the outset, the path of political
veto" and that he considers "more useful to know if there is reason
for there to be doubts of constitutionality" because "prevention is
better than cure".
On July
24, the President of the Republic submitted to the Constitutional Court the
decree of the parliament that changes the legal regime for the entry, stay,
exit and removal of foreigners from the national territory, approved by PSD,
Chega and CDS-PP.
The head
of state called for a preventive review of the constitutionality of the rules
on the right to family reunification and conditions for its exercise, on the
deadline for examining applications by the Agency for Integration, Migration
and Asylum (AIMA) and the right to appeal.
